Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the ministry is providing public notice of this request for consultation.
Proposal details
The Ministry of Municipal Affairs and Housing is consulting on a request for a Minister’s Zoning Order (MZO). An MZO, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
The Minister is considering a request from Matthews Canada on behalf of QuadReal Property Group for an MZO to facilitate employment uses in the Town of Caledon. The requested MZO specifically seeks to permit a wide range of uses such as storage, warehousing, offices, data centres, industrial uses, manufacturing, transportation and trucking uses, motor vehicle related services, factory outlets, financing institutions, restaurants, and retail uses. The requested MZO also seeks to include zoning requirements (e.g., maximum building heights, maximum building area, setbacks, etc.) intended to facilitate the proposed development concept.
The subject lands are approximately 82 hectares in total, being comprised of portions of two properties (12469 and 12861 Dixie Road) in the Town of Caledon. For clarity, the lands subject to the zoning order are adjacent to, but not located in, the Greenbelt Area. The subject lands are located within an approved settlement area boundary and currently designated for new employment uses in the Town's Official Plan.
The Ministry received a letter from the Minister of Economic Development, Job Creation and Trade on March 3, 2026, indicating that he was supportive of the request for a Minister’s Zoning Order on the subject lands, noting his Ministry was supportive of initiatives that contribute to job creation, industrial growth, and regional economic development.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and is seeking additional information from the public and other stakeholders that may help inform a decision.
This proposal for an MZO is posted for consultation as a “regulation” notice type due to webform template formatting limitations. However, as a result of amendments to section 47 of the Planning Act by Bill 60, Fighting Delays, Building Faster Act, 2025, which received Royal Assent on November 27, 2025, the proposed MZO, if made, will not be a regulation and will not be filed with the Registrar of Regulations.
