The project consists of proposed development works including new parking lots (northwest, northeast and southwest of the Site), a proposed building north of the existing building with rooftop control, and small pockets of paved areas. In the existing condition, the Site is serviced by an existing dry pond, ditches, and OGS.
The southwest parking lot/drop lot development will have an underground storage tank with Isolator Rows and enhanced grassed swales serving it, with discharge flowing to Bell Creek.
The northern parking lots (northeast and northwest) will be serviced by two proposed dry ponds (one for each lot), with runoff conveyed via enhanced grassed swales to the existing drainage system, including ditches, the OGS, and the existing dry pond.
A proposed building with rooftop control will also convey to the existing dry pond downstream.
Portions of the proposed works were previously submitted under ECA application #4764-DNKNBS (ERO posting 026-0055). That application is administratively cancelled, and its contents have been consolidated into the current ECA application as part of this amendment.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for amendment to an existing Environmental Compliance Approval (industrial sewage works) No. 0836-BYTSTU for existing stormwater management facilities to service a proposed building, with rooftop control, and small pockets of paved areas of the existing Procter and Gamble Inc. site located at 355 University Avenue in Belleville.
The project consists of proposed development works including new parking lots (north of the site), proposed building (0.52 hectares) north of the existing building with rooftop control, and small pockets of paved areas. In the existing condition, the site is serviced by an existing dry pond, ditches, and oil grit separator (OGS). There is an existing amended Environmental Compliance Approval (ECA) permit in place for the existing dry pond, ditches, and OGS. The existing amended ECA permit number is 0836-BYTSTU (issued May 17, 2021).
The proposed stormwater management (SWM) strategy is to introduce proposed SWM features in the form of proposed dry pond (with active storage volume of 2156 cubic meters), controlled by 225 millimetres orifice and 1.25 meter weir, and 16 metre emergency spillway. The proposed dry pond provides quantity control for the proposed north parking lot. The runoff from the proposed dry pond is conveyed by grassed swale with bottom width of 1 meter, side slopes of 3H:1V and longitudinal slope of 0.3%, which provides some degree of treatment. Additional treatment is provided by the existing ditches and downstream OGS.
Future developments involving additional parking lot areas will require similar at-source or upstream proposed SWM controls. The proposed building (0.52 hectares) with rooftop control has a controlled release rate of 42 litres/second/hectares or 0.022 cubic metres per second.
