Establishment of stormwater management works designed to provide enhanced level of quality control, and attenuate post-development peak flows to allowable release rates for all storm events up to and including the 100-year storm event, consisting of:

Northern Catchment Areas (sub-catchments one to six and 12

  1. Three catch basin inserts, CB shield, to be installed in three catch basins (CB7, CB8, CB1), to provide TSS removal prior to discharging to the detention tanks;
  2. Three  storm drain filters, Uline, to be installed in three catch basins (CB3, CB4, and CB2), to provide protect catch basins from floating debris and sediment;
  3. Two witch hat filters to be installed inside CBMH2 and CBMH7 to protect CBMH from floating debris and sediment;
  4. Four precast concrete water detention tanks, installed in series to provide quantity control as well as additional water quality control, each with dimensions of 8.0 m L x 3.65 m W x 1.75 m H and having a storage volume of 30,150 L, discharging via a 500 mm diameter overflow pipe at the last tank to MH1 (overflow to MH2);
  5. One 350 mm orifice for controlled flow at 500 mm inlet pipe to MH1 which is located immediately downstream of concrete water detention tanks;
  6. One HydroStorm oil and grit separator, model HS-10 or equivalent, to be installed at MH3 located downstream of MH1, having a sediment storage capacity of 13,200 litres, an oil storage capacity of 4,328 litres, a total storage volume of approximately 20,000 litres, and a maximum treatment rate of 259.6 litres per second, discharging via a 600 mm outlet pipe to North West ditch;

Southern Catchment Areas (sub-catchments 7 to 11)

  1. Two catch basin inserts, CB Shield, to be installed in CB5 and CB6, to provide TSS removal prior to discharging to the detention tanks;
  2. Two precast concrete water detention tanks installed in series to provide additional TSS removal as well as stormwater quantity control, each with dimensions of 5.8 m L x 3.0 W x 1.88 m H and having a storage volume of 22,601 L, discharging via a 400 mm diameter outlet pipe at the second tank to CBMH5;
  3. One 135 mm orifice plate for controlled flow installed at the second detention tank outlet to existing CBMH5, discharging to the onsite wastewater treatment plant

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

The proposal is for a new Environmental Compliance Approval for industrial stormwater management works serving CHAR Tech Thorold GP Inc. as general partner for and on behalf of CHAR Bioveld Thorold LP, located at 3363 Davis Road, in the City of Thorold, Ontario.

The stormwater management works comprise of Stormwater Quality Control, Quantity Control, and Erosion Control works, and include storm sewers, catch basins, catch basin shields, detention tanks, and oil/grit separators, and will discharge to a drainage ditch located north and southeast of the facility, and ultimately discharging to the Twelve Mile Creek.
