Decision summary
We have approved updates to the Natural Heritage Assessment Guide (the Guide) for renewable energy projects. The updated Guide will ensure the ministry’s Natural Heritage Assessment process for renewable energy projects aligns with the regulatory amendments that were proposed to O. Reg. 359/09 (Renewable Energy Approvals Regulation).
Decision details
We have updated Natural Heritage Assessment Guide (the Guide) to align with amendments to O. Reg. 359/09 (Renewable Energy Approvals regulation). These updates include:
- Setting out the qualifications needed for someone to be considered a ‘qualified person’ under the Regulation in order to complete required activities and reports related to natural heritage.
- Removing and revising content to remove references to MNR’s previous role, including in reviewing materials from applicants.
- Updating and clarifying criteria and procedures for undertaking required natural heritage assessment activities.
- Updating technical requirements for completing a wetland assessment (in some cases, a wetland assessment is an option for proponents who choose not to complete a full wetland evaluation if they treat the wetland as if it were provincially significant).
- Updating and merging previously separate bird and bat guidelines into the updated Guide, which includes reflecting the regulatory amendments that provide an exemption from developing an Environmental Effects Monitoring Plan for birds and bats if development occurs outside of bird and bat significant wildlife habitat and its adjacent lands.
- Simplifying procedures for identifying candidate significant wildlife habitat, to be consistent with other processes.
- Requiring internationally recognized “Important Bird Areas” to be considered as significant wildlife habitat.
- Removing duplicated content already in MECP’s regulation.
- Re-formatting and re-organizing remaining content in the Guide to improve readability for users.
- Note: while the Ministry initially proposed to remove content related to provincial parks and conservation reserves from the Guide, this content was retained but consolidated into a separate section in the Guide.
Changes to the Guide align with MECP’s regulatory amendments to Ontario Regulation 359/09. The regulatory amendments continue to ensure Natural Heritage Assessments are completed according to the Natural Heritage Assessment Guide and will maintain regulatory oversight including consultation requirements.
The updated Guide is incorporated by reference in Ontario Regulation 359/09 pursuant to section 177(5) of the Environmental Protection Act (EPA). This decision notice provides the notice required by section 177(6) of the EPA to give effect to the updated Guide.
Effects of consultation
In general, there was support for many of the proposed updates to the Guide. However, some comments received cited concerns related to the ministry’s shifting role to no longer review natural heritage assessments and environmental effects monitoring plans.
In addition to collecting feedback through the Environmental Registry posting, MNR conducted six in-person/online Indigenous consultation sessions on the proposal between January 20 and February 5, 2026. Over the six sessions, 81 participants representing 57 Indigenous communities and organizations were engaged. In early February 2026, MNR held three topic-specific sessions including this proposal as part of combined consultation on LT2 proposals. MNR also held one-on-one meetings with five individual communities between December 8, 2025, and April 13, 2026.
Several concerns were received related to the ministry having a reduced oversight role, no longer reviewing or confirming natural heritage assessments and monitoring plans, and changes related to allowing streamlined wetland assessments for certain wetlands.
All input received during the consultation period was considered and a decision was made to move forward with the proposal.

Proposal details
Background:
The Renewable Energy Approvals (REA) regulation (O. Reg. 359/09 or the REA Regulation) under the Environmental Protection Act requires applicable renewable energy projects to complete a Natural Heritage Assessment (NHA). Through the NHA, applicants identify any natural features at or near the proposed project location, follow procedures to determine if development prohibitions apply, and prepare an Environmental Impact Study (EIS) where required.
The Natural Heritage Assessment Guide for Renewable Energy Projects (or the “Guide”), supports the completion of an NHA and EIS by setting out evaluation technical criteria and procedural guidance to address natural heritage protections required by the REA Regulation.
The REA Regulation also requires applicants proposing wind power projects to prepare an Environmental Effects Monitoring Plan in respect of birds and bats. The plan must be prepared in accordance with the Ministry of Natural Resources (MNR) bird and bat guidelines. The bird and bat habitat guidelines provide guidance on identifying and assessing bird and bat habitat and addressing potential negative effects on their habitats during the planning, construction, and operation of onshore wind power projects in Ontario.
Proposed Changes:
In alignment with the proposed amendments to O. Reg. 359/09, changes to the following guides are being proposed:
- Natural Heritage Assessment Guide for Renewable Energy Projects
- Bird and Bird Habitats: Guidelines for Windpower Projects
- Bat and Bat Habitats: Guidelines for Windpower Projects
The Natural Heritage Assessment Guide for Renewable Energy Projects (the "Guide”) is proposed to be amended as follows:
- The Guide would outline the training, skills or experience required for an individual to be considered qualified to prepare natural heritage assessments and reports.
- Appendix C (Wetland Characteristics and Ecological Functions Assessment for Renewable Energy Projects) would be updated and simplified for certain wetlands (e.g., northern wetlands), where a full wetland evaluation is not required.
- Criteria related to the evaluation of significance of some natural features would be amended. Amendments would be made to:
- procedures for evaluating significant wetlands to align with the 2022 update to the Ontario Wetland Evaluation System manuals
- technical criteria for evaluating significant woodlands
- Content from the Bird and Bird Habitat and Bat and Bat Habitat Guidelines would be incorporated into the Guide and the bird and bat guidelines would be rescinded. Changes would:
- result in a simplified protocol with no monitoring requirements for applicants who avoid key habitats and implement known effective mitigation strategies to reduce mortality risks and potential displacement impacts to birds and bats
- update specific requirements (e.g., setbacks, monitoring protocols) to reflect new information
- identify requirements under the Fish and Wildlife Conservation Act, 1997 that may apply to persons carrying out activities pursuant to a renewable energy approval.
- Changes would be made throughout the Guide to clarify MNR’s roles and responsibilities, including to:
- update references to geospatial and other information sources
- remove content related to provincial parks and conservation reserves
- update MNR’s role in REA applications to align with proposed regulatory changes to O. Reg. 359/09.
- Other housekeeping changes to improve clarity and readability and to update or remove out of date content.
Regulatory impact analysis
- The proposed amendments are anticipated to have a neutral to positive impact on business as a result of simplifying requirements to complete a Natural Heritage Assessment.
- The proposed changes are intended to provide greater certainty for businesses who want to invest in developing renewable energy projects.
- Through this posting, we are seeking input on anticipated benefits or costs to Ontario businesses to better help the ministry understand the real costs or cost savings associated with these proposed changes.
