I previously shared an ERO comment expressing my concern with the Protect Ontario by Unleashing Our Economy Act, 2025 (Bill 5). While my concerns are many, I commented on the need for the rule of law – by Provincial Parliament. Not by Cabinet and not by a Minister. I commented on the need for an arm’s length relationship between the body that passes legislation and the body that implements legislation.
The criteria proposed for selecting Special Economic Zones adds to my concern. Even if the proposal includes worthwhile criteria, the lack of a universal process and the fact that the decision would be overseen by the Minister or Cabinet undercuts the value for me. I see the test of the Minister’s opinion as a massive red flag. Not simply because this government has presided over processes that have involved substantial corruption with the Greenbelt, the Urban Boundary Expansions and the Ontario Skills Development Fund, but because no minister of any government should have such power.
By contrast, if the government chooses to publish a set of additional minimum criteria needed to justify any proposed project, anywhere throughout the province, that could deliver greater certainty to proponents and direction for local decision-makers. Other measures to expedite planning processes, without reducing consultation, instead of attempts at bypassing required assessments and consultations, could also be beneficial.
