I would like to take this opportunity to express my concerns about the proposed changes to Municipal Class Environmental Assessments. I request that these changes not be implemented and this proposal be withdrawn.
My concerns include the following:
The Ministry is downloading its duty to care for the Environment to municipalities without guiding, supporting, or supervising the process. This is wreckless and irresponsible and will add to the burden of costs municipalities already face as a result of other recent changes imposed by the provincial government, including but not limited to Bill 23.
The proposal removes the need to investigate and mitigate impacts on cultural heritage resources, for most municipal infrastructure projects. These resources contribute in significant ways to the unique character of communities and their value should not be ignored or overlooked.
Of particular concern is the unacceptable way that Indigenous and/or treaty rights are dealt with in the new the proposal. The changes pose great risks to Ancestor burial and archaeological sites. This proposal does not fulfill the constitutional Duty to Consult and Accommodate. It puts Ontario in violation of the United Nations Declaration of the Rights of Indigenous Peoples (UNDRIP) which Canada adopted in 2016.
