The application for consent was draft approved on July 28, 2026 subject to conditions.

The application was reviewed for consistency with the environmental policies of the Provincial Planning Statement. No public comments were received.

No specific concerns related to fish or wildlife habitat, species at risk, protected areas or public health and safety were identified in relation to this application. Given that the development is on existing developed lands, the small-scale of development itself, and mitigation measures there will be no negative impacts to greenspace, natural heritage and water quality and quantity, nor public health and safety.

Approval is subject to standard conditions related to finalization and additional conditions related to the mitigation of negative impacts and consistency with the Provincial Planning Statement

These additional conditions include:

  1. That prior to final approval, this Ministry must receive a letter from the Northwestern Health Unit (NWHU) which states that both the severed and retained parcels have been inspected by the NWHU and are suitable for the installation of a subsurface sewage system or that the existing systems meet their requirements.
  2. That prior to final approval, and pursuant to subsections 53(12) and 51(25) and 51(26) or (27) of the Planning Act, the applicants shall enter into a Consent Agreement for the severed and retained parcels with the Ministry of Municipal Affairs and Housing (MMAH), to its satisfaction, addressing the potential development of the lands, including:
    1. the parcels can only be used for resource-based recreational uses (including a recreational dwelling) and is not to be used for permanent residential, commercial or industrial uses;
    2. restrictive covenants, prepared to the satisfaction of the Ministry of Municipal Affairs and Housing, to consolidate via Section 118 of the Land Titles Act (LTA) the northern and southern portions of the severed and retained lots (separated by Burma Road);
    3. The Consent Agreement will be registered on title; and
    4. Provisions to obtain undertakings from the applicant to implement conditions and requirements (e.g. registering the restrictive covenant and Consent Agreement on title)
  3. That prior to final approval by this Ministry, a flowage easement to elevation 324.6 metres CGVD 1928 (Canadian Geodetic Survey Datum of 1928) is required on the severed and retained lands provided a flowage easement or hazard land zone to the level does not already exist.  

The applicant has two years to satisfy conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before August 18, 2026.

Appeal Rights under the Planning Act

Other than the applicant, only a "specified person" or "public body", as defined in s. 1(1) of the Planning Act, has the ability to appeal the decision to the Ontario Land Tribunal.

The purpose of this early-consultation application is for the creation of a new lot to rectify an inadvertent merger on title which occurred in 2021, and to realign property boundaries to be more reflective of on the ground use. 

The severed lot would be 1.7 hectares with 145 metres of frontage on Clearwater Bay and 365 metres of depth. The severed lot is developed by a main cottage, a garage, wood shed, dock and boat port. The retained lot would be 1.7 hectares with 247 metres of frontage on Clearwater Bay and 275 metres of depth. The retained lot is developed by a cottage, dock and boathouse

The effect of creating this new lot would be to allow for existing uses being resource-based recreational use, to remain in place while having separate title to the properties, to allow for the properties to be transferrable in the future.
