Decision summary

Four policies (three updated and one new) have been developed to align with the requirements of the Aggregate Resources Act, O Reg 244/97 and the Aggregate Resources of Ontario: Technical Report and Information Standards (the Standards).There are also 28 policies being rescinded due to outdated guidance or that are no longer necessary.

Decision details

Three outdated policies were updated, and one new policy was developed in relation to aggregate licence/permit applications to support our government's vision to build Ontario. These updates will also reduce burdens to the aggregate industry by providing clarity, while managing community impacts and maintaining strong environmental protections.

The Maximum Predicted Water Table Report (MPWTR)

The MPWTR was introduced in 2021 as a new requirement for all new applications (i.e. licence, permits, wayside permits).

This new policy was developed to guide implementation of this new requirement. This policy defines key hydrogeological terms and lists requirements and best practices for determining and reporting the water table. It also contains links to information sources, prescribed requirements, and contacts within the Ministry of Natural Resources (MNR) and the Ministry of the Environment, Conservation and Parks (MECP) related to water.

Updated Policies

The Water Report 

The Water Report is an existing requirement for new applications proposing to extract below the water table and was previously known as the Hydrogeological Report. This policy lists requirements and best practices for reporting on potential impacts to water resources.

Cultural Heritage Report

The Cultural Heritage Report is required to document how potential impacts to cultural heritage resources have been assessed and/or will be mitigated. This policy provides guidance on how to prepare a cultural heritage report to support an aggregate application as well as guidance on implementation of a new provision (2021 Standards) – ‘avoidance and protection’ – at aggregate sites

Matters to be Considered in the Issuance of a Licence

Section 12 of the Act lists several matters which the minister and Ontario Land Tribunal must consider when deciding whether to issue an aggregate licence. This policy provides direction for how ministry staff will evaluate licence applications with respect to these matters, to recommend to the minister whether to issue the licence.

Effects of consultation

Proposed changes to three policies, the introduction of the new MPWTR policy, and the rescission of 28 outdated policies were posted on the Environmental Registry of Ontario for a 45-day consultation period from August 8 to September 26, 2025. Feedback was received from the public, municipalities, Indigenous communities, stakeholder organizations, industry, and government agencies.

While submissions reflected a range of perspectives, common themes emerged. Revisions were made where appropriate, primarily to improve clarity, consistency, and implementation, while comments outside the scope of the proposals did not result in changes.

For the MPWTR policy, most comments related to technical standards or monitoring requirements established in the Aggregate Resources of Ontario: Technical Reports and Information Standards and were therefore out of scope. Changes focused on administrative improvements and clarification of when Water Reports are required. The policy now also clarifies that potential surface water impacts may need to be assessed through a Natural Environment Report, even where extraction remains above the water table.

Revisions to the Cultural Heritage Report policy focused on improving guidance related to Indigenous engagement, checklist documentation, and clarity around areas to be assessed. The policy now emphasizes early Indigenous and municipal engagement, clearer eligibility criteria for Avoidance and Protection measures, and administrative improvements to enhance usability.

Updates to the Matters to Be Considered policy clarified terminology, regulatory roles, and thresholds for technical reports, reorganized agricultural considerations, and aligned language with the intent of the Aggregate Resources Act. The policy also confirms the ability to consider site-specific or unforeseen issues during application review.

Overall, the changes strengthen policy clarity and consistency while maintaining alignment with existing legislative and regulatory frameworks

Proposal background: aggregate policy updates project

  • Since 2009, several changes to the ARA policy framework (including amendments to the act and regulation (Ontario Regulation 244/97), and the standards have rendered aspects of these policies outdated, incorrect, or no longer applicable.
  • Changes to other provincial statutory frameworks, government practices, processes, and priorities have also impacted the accuracy, currency, and relevance of some aggregate resources policies.
  • We are proposing updates to three policies (replacing seven outdated policies), and one new policy, related to new aggregate applications. We are also proposing to rescind 28 outdated or inaccurate policies.

Policies being proposed for updating or development

  • Three of the policies proposed provide information, direction, and guidance regarding the preparation of three specific technical reports which are required by the Aggregate Resources of Ontario: Technical Reports and Information Standards (August 2020) for new aggregate licence/permit applications – namely, Maximum Predicted Water Table Report, the Water Report, and the Cultural Heritage Report.
  • Of these, the proposed Water Report and Cultural Heritage Report policy proposals are updates to existing policies whereas the Maximum Predicted Water Table Report policy proposal is a new policy based on a new (2020) requirement in the Aggregate Resources of Ontario: Technical Reports and Information Standards.
  • The fourth proposed policy relates to Section 12 of the ARA, which details the specific matters the Minister or the Ontario Land Tribunal must consider when deciding whether to issue or refuse an aggregate licence. This new policy will help applicants understand what the ministry considers when reviewing a licence application and will provide guidance to staff in their review of applications and when making recommendations to the Minister for licence applications.
  • If approved, the three updated policies would replace the following aggregate policies:
    1. Updated Water Report policy:

      • A.R. 3.01.04. Wayside Permit Applications: Hydrogeological Report Standards

Policies being proposed for Rescinding

  • We also propose that 28 policies (including two policy manual appendices), which have become outdated, redundant, or inaccurate, be rescinded (see Supporting materials, below).
  • We expect that rescinding these policies and removing them from the aggregate resources policies webpage will reduce burden by providing greater certainty and clarity to industry and the public about current program requirements and processes.
  • This, in turn, would contribute to the ongoing modernization and streamlining of aggregate resources policies, thus improving consistency and efficiency in Ontario’s aggregates program delivery.

The environmental consequences of the policy proposals are anticipated to be neutral. The proposed policies reflect previously approved changes to the ARA framework (including amendments to the act and regulation, and development of the Aggregate Resources of Ontario Standards).

The anticipated social consequences of the proposal are neutral to positive. Regulatory standards remain in effect. The policy proposals are intended to provide information, direction/ guidance, and clarity, and remove outdated, redundant, or inaccurate policies.

Regulatory impact analysis

The proposed policy updates will provide the regulated community with greater certainty when completing mandatory reports, including knowing what matters the ministry considers when reviewing applications and making licensing decisions. Rescinding 28 policies would also clarify for the regulated community which policies no longer apply. Consultation with the regulated industry will help inform cost calculations to determine decreases in financial burden to industry.
