The proposed changes would provide no protection for both known and unknown archaeological sites, including First Nations Ancestor burials, in the construction of the exempted categories. This streamlining of environmental assessments would likely result in the disturbance of indigenous grave sites. The Chippewas of the Thames First Nation have raised concerns that changing the EA regulations in this way would result in reduced consultation with First Nations on development projects, a step that would fly in the face of UNDRIP and the TRC Calls to Action.
